Police said an 82-year-old woman was pronounced dead by a New York nursing home worker. Later found to be breathing after nearly three hours.

At Water’s Edge Rehab and Nursing Center at Port Jefferson in Long Island, an older adult was declared dead at around 11:15 a.m. on February 4.

Furthermore, according to Suffolk County police, at around 1:30 p.m., she was taken to O.B Davis Funeral Home in Milker.

At around 2:09 p.m., the Davis Funeral Home staff members saw the woman gasping for air. Later she was shifted to the hospital, police said. 

Suffolk County police could not provide critical updates on the unidentified woman’s condition. 

Davis Funeral Home and Water’s Edge Rehab and Nursing Center did not respond to any request for comment.

This incident has been introduced to New York Attorney General Letitia James’ office.

The Attorney General Office’s spokesperson said, “This is an awful situation that has caused unnecessary trauma for the impacted resident and her loved ones.”

The spokesperson did not update whether the nursing home would be fined or charged.

The state’s Department of Inspections and Appeals said staff at the facility checked on the woman at 6 p.m., January 3, and pronounced her dead after found no sign of life.

Moreover, the unidentified old woman’s body was later shifted to a funeral home, where the workers saw her “chest was moving and she was gasping for air.”

When the funeral home’s workers found her alive, they called the authority, and later she was transferred to a hospital in the emergency room. According to the report, she died after two days.

However, the facility was fined $10,000, the maximum allowed under Iowa law, by the state.
